These terms and conditions are in place to ensure the safety and enjoyment of all our customers.

Health and safety
Prior to your charter you will have a safety briefing and boat hand over and must fill in the booking form. We will need to see your qualifications appropriate to the cruising area you are using, and may ask to see your log book too.

If you have any medical conditions, please make a note of this on your booking form and inform a member of staff.

An Adult (18 years or over) must be onboard and responsible for the operation of the vessel.

Mylor Boat Hire reserve the right to cancel your Charter if they feel you are likely to cause danger to any person, persons or property.

Please understand there is a risk of injury and death in all Watersports.

If conditions are in excess of force 6 the vessel is to remain in a marina or suitable anchorage. If the vessel is in Mylor and it is too windy to sail then a berth will be provided. Please note bad weather is not a reason for a late return, monitor the forecasts and plan your trip accordingly.

Payment

No booking is regarded as confirmed until a 50% deposit is received; with the balance due 3 weeks before the start of the Charter. Bookings made with less than 3 weeks notice will need to pay the full amount at the time of booking.

Prior to arrival we will take a deposit by bank transfer of £1000, this will be held for the duration of the charter and up to 7 additional days; in the event of the charter finishing on a weekend/public holidays, or if we need to see the guidance of an external sub contractor. The Deposit will be returned via bank transfer minus any damages or penalties.


Refunds and cancellation
Cancellations by us:
We reserve the right to cancel any of our Charters at any point due to circumstances outside of our control such as: adverse weather conditions or equipment damage.  You will be given a full refund unless an alternative vessel or dates are available and agreed. Mylor boat hire will only refund a value up to the value we have received, we will not be liable for any other costs incurred. We recommend you take out insurance to cover any other costs.

Cancellations by you:
Cancellation of charters with less than 3 weeks’ notice will not be entitled to a refund.

Cancellations of charter with over 3 weeks’ notice will receive a full refund -minus 5%.

Equipment Damage
We pride ourselves on the high standard of our equipment so please inform us of any damage you find prior to your activity. You are obliged to report any damage or incidence however minor, as we may be required to have an external surveyor confirm the condition of the vessel.

Any damage or missing equipment will be deducted from the damage deposit.

Returning the vessel

The vessel must be returned to the same location from which it was hired unless otherwise agreed, if you return the vessel late then you will be liable to pay £100 for every hour or part thereof. Should the vessel be returned in a dirty or untidy state there is a cleaning charge of £250.  Both of these charges will be deducted from the damage deposit.

The vessel must be returned with the fuel tank full. If the boat is not full, the cost of refuelling plus £50 will be deducted from your damage deposit.

The vessel must be returned with the holding tank empty. the tank hasn’t been emptied a fee of £150 will be incurred.

Should you incur fines/fees in excess of the damage deposit, you agree to settle these before leaving at the end of your charter.

Misbehaviour

Anyone who, in the opinion of Mylor Boat Hire staff, is unfit for any charter or who behaves in such a way likely to cause danger to themselves, other customers or other water users will be excluded from charters. Smoking is strictly prohibited inside, smoking is permitted on deck at the leeward side so no residue remains on board. At all times there must be a qualified skipper and crew capable of handling the vessel (under the legal drink drive limit). Drugs are never tolerated on board.  Charters terminated by us due to misbehaviour, consumption of alcohol or drugs or smoking inside will not be entitled to any refund of the balance of the charter or damage deposit.

Liability

Mylor Boat Hire insures the vessels for public liability but it will not be responsible for any loss, damage, or injury to the customer party or possessions, howsoever caused. The customer will be liable for a minimum of £1000 for damage or loss to any vessel. The customer uses the vessel at their own risk and Mylor Boat Hire accepts no liability for any damage, loss, or death as a result of any vessel or equipment.

Maximum Capacity and Limit of Operation.

We reserve the right to terminate hire at any time and repossess the boat if we have reason to believe you are not adhering to the following maximum capacity and limit of operation. MAXIMUM 8 PERSONS, NO DOGS.

Skipper must have previous experience of at least one month as skipper of a similar size vessel and hold a minimum of RYA Day Skipper practical qualification.

Coastal Skipper or above

Western limit – Scilly Isles , Easten limit – to be discussed.

Day Skipper

Nare point – Plymouth

The vessel must remain in UK waters at all times, the off shore limit for day skippers is 15 miles.

Confirmation
By signing for responsibility of the vessel you confirm that you agree to be bound by these Terms and Conditions.
